The Act also extends to things such as promotions and compensation, as well as the terms, conditions, and privileges of employment. It applies to companies with 20 or more employees.

Employers with six or more employees also fall under the Virginia Human Rights Act (VHRA). It forbids employment practices that discriminate against applicants and employees based on their age.

Age discrimination is more common than you may think. A survey conducted by AARP found that nearly 2 out of 3 workers ages 45 and older have seen or experienced age discrimination at work. Many of these respondents felt vulnerable because of their age and found that age bias made it hard for them to find new positions.

  • Job advertisements that have age-related specifications or dates
  • Being overlooked for promotions or difficult work assignments
  • Being encouraged or forced to retire
  • Having your position eliminated and replaced with a younger employee in the same capacity
  • Experiencing unfair discipline
